Policy on Receiving Gifts

A few weeks from now, we will begin to feel a lot more like Christmas. It's the time of the year when the tradition of giving and/or receiving gifts and holding parties is at its best.

While waiting for this special occasion to finally unfold, we again take this opportunity to enjoin everyone to observe the following guidelines on gifts and entertainment.

 

Type of Gift(s)

Disposition

1. Solicitation of gifts of any kind and of any value.

This is not allowed.

2. Acceptance of cash, check, gift certificates or other cash equivalent of any amount, free membership or subscriptions (e.g. sports or other clubs) estimated to be more than Php4,000.00

This is not allowed.

It should be politely refused and returned to the giver.

3. Perishable gifts (fruits, cakes, lechon, etc.) 

  1. Equal to or less than Php4,000.00 

  2. Estimated to be more than Php4,000.00

 

  1. This is allowed; goes to the intended recipient.

  2. This is allowed; to be shared and consumed by the employees in the business unit to which the recipient belongs.

4. For gifts in kind (non-perishable)

  1. Equal to or less than Php4,000.00 

 

  1. Estimated to be more than Php4,000.00.

 

  1. This is allowed; goes to the intended recipient.

 

  1. Please declare said gift using the attached form and turn over the item to the controllers. For gifts received from today until January 2013, these will be raffled off in your respective companies in January 2013.

5. Personal use for free or at abnormally low cost by MPTC, MPTDC, MNTC or TMC employees

of property or facilities of third party business partners dealing with MPTDC, MNTC and TMC.

This is not allowed.

It should be politely refused.

 

6. Attendance at or sponsorship of Christmas Parties by third party business partners exclusively for MPTC, MPTDC, MNTC and TMC.

 

This is not allowed.

It might make us feel compelled to reciprocate or grant special favors as a result.

7. Attendance at Christmas Parties of third party business partners which are open to other nonMPTC,MPTDC, MNTC and TMC employees.

This is allowed.

It is viewed as an opportunity to strengthen and enhance general business relations or partnerships in the industry.

8. Raffle tickets/prizes or other promotional items given by third party business partners during

their Christmas Party won by or given to an attending MPTC, MPTDC, MNTC or TMC employee.

This may be accepted and kept by the recipient / winner regardless of value provided:

  1. it is an open party, meaning, there are attendees/guests other than MPTC, MPTDC,

MNTC or TMC employees;

  1. all the attendees/guests are likewise given or entitled to such raffle tickets/prizes

  2. all attendees/guests are given equal opportunity to win prizes.

 

The Controller’s Office of the respective companies shall be the repository of gifts and declaration forms for those classified under item 4 above.

Finally, as a general rule, a gift recipient should inform his/her superior of an offer or receipt of a gift if he/she is not sure what should be done, copy furnished the Corporate Governance Office for guidance.
